Ich habe Herrn Mauléon gefragt, welchen Wert heutzutage Patente noch haben, wo alles von den Chinesen kopiert wird, die sie nicht respektieren. Seine Antwort, von mir aus dem Französischen übersetzt:
Gewiß kopieren die Chinesen Patente, aber ihre Produkte stellen damit Fälschungen dar, die im Land des Patentinhabers und den Ländern, wo er entsprechende Patente erworben hat, nicht frei verkauft werden können ohne das Gesetz zu verletzen. Die Jagd auf Fälscher geschieht ernsthaft in allen großen Industrieländern (durch die Ämter für Patente und Markenschutz und auch den Zoll) und das in allen Industriebereichen, sogar dem der Spielwaren. Man muß das Patent als eine Art Versicherung gegen die Risiken der Erfinder betrachten, daß ihre Erfindungen nachgemacht werden. Das Patent ist auch eine Art Qualitätssiegel, das dem patentierten Gegenstand Glaubwürdigkeit und Wert verleiht.

Danke für diese sehr interessante Aussage aber wo ist der Scoop?
Daß die Chinesen, und vor denen die Japaner, und nach den Chinesen wahrscheinlich die Inder, alles kopieren ist ja so alt wie Methusalem. Glaube daher nicht daß der Herr Mauleon mit dieser Meinung das warme Wasser erfunden hat.

Ja ja, es wird immer wieder funktionieren. A baut was, B kopiert es - aber schlecht und C kopiert es massenhaft. Und: die Leut' kaufen's... Zoll und/oder anderweitige Fahnder - die Produzenten pfeifen sich genau gar nichts um die.

Wenn man weiß, wie viele Container Europa in Rotterdam, Hamburg udgl. erreichen... man kann sich ausrechnen, wie viele Container tatsächlich gecheckt werden können.

Und um Europäische Patentämter haben sich diese Produzenten noch NIE etwas gesch...

In patent field there are two main approaches: 1) the acquisition of patents and 2) the defense of the patents in front of the infringers.

I am essentially interested here by the first step, and my objective is to complement the fascinating history of toy trains in exploring a field which is hitherto little known and merits to be visited : it is that of the industrial property taken by the firms that have worked on the construction of toy trains and have often made, in this context, really innovative technical works which have been protected by filing, in particular, patents whose descriptions, figures and plans are always very interesting. How to pay a best homage to the efforts that have been provided by firms like DISTLER (and many others), if not to offer the reading of the obtained patents. The innovative and judicious character of many pieces of train (created simply as toys) is evidenced by said patents.

In addition, the preparation and filing of a patent applications and the carrying out of the substantive examination procedure in order to obtain a patent before a State Office such as the Deutsches Patentamt, constitute a kind of "the Way of the Cross" which reinforces the respect that we must bear towards inventors.
